How am I able to know if my design is new and unique?

In order to prevent future conflicts, it is recommended to check design registers before applying for design protection. The respective registers will provide information about all registered designs. This way you will be able to learn if your design is unique or not.

Why should I protect my design?

Officially registered designs can be used to stop people from copying or stealing your design. It gives the owner of the registered design a stronger position if a third party starts making or trading a design that is similar to yours. Registered design enjoys additional protection to the copyright protection that it may already enjoy as an original work of art. The registration certificate provides you with a solid proof of legal protection in particular jurisdiction where it is registered in.

What are the requirements for the registration of a design?

In most jurisdictions, to register a design, it must be new and possess individual character. A design is new if no identical design has been disclosed before it. If two designs differ only in immaterial details, they will still be considered identical. A design possesses individual character if the overall impression conveyed to the informed user differs from that conveyed by any other previous designs.

What is the time frame of the design application procedure?

Usually, the process of registering a design takes about 9 to 12 months. It depends on the applicant, the actions of the interested party and specified law terms.

After submitting an application, the design is not published for 6 months. However, the publication of the design can be postponed up to 30 months by owners request.

When the design registration is announced, third parties may file an opposition within 3 months from the date of publication.
From the date of filing the design application, the priority right to the design arises and temporary protection is granted until the design certificate is issued.
