After officials examine your trademark to see if everything is in place, it is necessary to publish the trademark to let a third party, if they have a valid reason, present oppositions to the registration of your trademark. International trademark registration under MADRDID System has advantages and disadvantages. Here are few of them:
-Simplicity to file an application. You will need to file only one application in one language.
-Cost-effective. You will save time and money by filling one application.
-Global. Currently, it’s the main solution for international trademark registration.
-The applicant must have nationality, domicile or business incorporation in the base country.
-The international trademark remains dependent on the base country trademark for 5 years since the international filing date. If during the first 5 years, the base country trademark is rejected, removed, canceled or limited, the international trademark will be canceled.
-Restriction of amendment and assignment.
An application of trademark registration should be applied in the country you want to use your trademark. If you are willing to use your trademark in different countries, you have to register your trademark in those particular countries or regionally, provided your listed countries belong to a particular region (e.g. the European Union). Keep in mind that every country has its own trademark register.
There is also a possibility to obtain trademark registration in different countries by filling just one trademark application. There are countries that co-operate, also regions, like European Union, that give the opportunity to use a trademark in all listed countries just by filling one application. International trademark can be filed for those countries that participate in the international Madrid System, however, it is not highly advisable to apply for a trademark protection in big countries such as USA, China, Russia etc. via international system.
A trademark is only protected in the country or region (provided regional registration is available) where it was registered. If there is a need to use a trademark abroad, people are able to apply for a trademark registration in each country or file a European or international trademark application. However, while European trademark covers all European Union countries, a genuine international trademark does not exist. The international trademark registration system (Madrid System) only simplifies the process for filing multiple national applications.
